 Has Your Hospice Gone Wild With Waivers and Lost Focus?

Many hospices saw the 1135 waivers issues by CMS during Covid-19 as a saving grace. The 1135 waivers were certainly meant to provide hospices relief from the burden of trying to meet some of the CoPs while addressing the emergent crisis of the pandemic. If you are a hospice who applied, for, received and used the waivers as intended and stipulated then their intent was met.

Let’s look at other considerations as well. Although the waivers were relief for some of the CoP requirements, they did not make allowances or waive technical elements such as the face to face, election of benefits, CTI and recertification time frames. We also understand that audit activity (TPE, SMRC, UPIC) will resume once the pandemic ends.

If a hospice has applied the waivers to areas not intended or specifically allowed, there could be risk for non-payment and audits in the future. Hospices that have not taken time to reflect on their documentation practices in regard to supporting technical and clinical eligibility during the pandemic may find the post Covid- 19 landscape harsh.
