Are you taking the necessary precautions to keep both patients and employees safe? Risks within a client’s home include infectious disease, firearms, harassment, and even discrimination. Learn to respond to patients and staff in compliance with the CoPs and your obligation to employee safety.

Homecare employers are responsible for providing a safe working environment for employees. Unlike other employers, they primarily send personnel into patient homes. The workplace is not only decentralized, but is also subject to many variations – all of which could cause liability. Homecare employees face risks ranging from patients’ infectious diseases (a lesson learned from the current pandemic), to animals, and even firearms. An employee can be harmed by any number of things; it’s the employer’s job to prevent this.

Prevention involves considering agency policies and standards, infection control, and discharge procedures that clearly spell out how to handle patient discharge when safety is an issue. Employers must also consider other aspects of safety and training. Employee training should include proper use of PPE. Teaching staff when to leave if safety becomes a concern is also imperative. However physical safety is not the only issue. Harassment and discrimination can also take place in a patient’s home and homecare employers must act on such reports. This jam-packed session will examine these concerns and how to respond to patients in a manner that complies with the CoPs and with an employer’s obligations to employees.

Robert is an attorney with Hall, Render, Killian, Heath & Lyman, P.C.  He focuses his practice on representing home health, hospice, and private-duty providers.  With over a decade’s experience, he works on issues related to Medicare and Medicaid compliance including surveys, responding to surveys, state and federal appeals of survey findings; payer issues, including appealing payer audit findings; HIPAA compliance; Medicare and Medicaid fraud and abuse, including developing and implementing compliance programs, performing internal investigations and representing providers in external investigations and civil and criminal matters.  Robert further assists clients with purchasing and selling home health, hospice, and private-duty agencies.

Because these providers depend heavily on their staff, Robert also addresses legal issues related to employment matters.  A frequent speaker, Robert graduated from Hanover College with a degree in Computer Science and received his law degree from Indiana University School of Law.  Robert is certified in health care compliance by the Health Care Compliance Board and is admitted to practice in Indiana and Oklahoma.
